Did the Police have Probable Cause to Stop You?
A police officer cannot simply pull you over to make an arrest. He or she must have probable cause to pull you over. There must be a good reason to suspect you are driving while intoxicated or breaking another law, such as speeding, swerving, or other evidence of impaired ability.

Will Challenging the Evidence Help?
The outcome of any drunk driving case depends upon the prosecutor's ability to prove you were driving while intoxicated or that your blood alcohol level was .08 or greater. The proof must be beyond a reasonable doubt.
The state may use testimony by the patrol or police officer regarding his observations of your behavior such as slurred speech, clumsiness or confusion. Other evidence which is often used to demonstrate that you were driving drunk are the results of field sobriety tests, blood tests, and breath tests.
